1. Introduction

Welcome to ProXmTest. By accessing or using this platform, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms, you must stop using the service.

2. Definitions

“Platform” means the ProXmTest web application and related services.

“Examiner” / “Teacher” means any registered user who creates and manages tests on the platform.

“Examinee” / “Student” means any user who participates in tests created by an examiner.

3. Eligibility

To use ProXmTest as an examiner, you must be at least 18 years old or have appropriate institutional authorization, and you must accept these Terms.

4. Acceptable Use

You agree to use ProXmTest responsibly and only for legitimate testing and examination purposes.

Because the platform is offered in a free version, certain limitations and vulnerabilities may exist. Improper or abusive use — especially by examiners — may negatively affect system stability and other users.

You agree not to:

• Perform actions that overload or attempt to overload the server
• Run automated scripts, bots, or repeated requests that stress the system
• Attempt to stress‑test, attack, probe, or exploit the platform
• Create excessive numbers of tests or accounts in a way that harms performance
• Use the platform in ways that disrupt or degrade service for other users

Any behavior that risks platform stability or degrades service for others may result in immediate suspension of the affected account.

4.1 Credential Confidentiality

Examiners agree to keep their login credentials strictly confidential. You must not share your email address, password, or any access tokens with other persons, including colleagues, students, or third parties.

You are fully responsible for all activity performed under your account. Sharing credentials may lead to unauthorized access, data corruption, or service disruption. Accounts involved in credential sharing or unauthorized access may be immediately suspended.

4.2 Legal Compliance

Examiners agree to use ProXmTest in full compliance with all applicable laws and regulations, including:

• The laws of the European Union, where relevant
• The laws of their own country or jurisdiction
• Any institutional or educational rules that apply to their activity

Examiners are solely responsible for ensuring that their use of the platform respects privacy, data protection, copyright, and all other applicable legal requirements.

5. User Accounts

Examiners must provide a real email address for login and account recovery. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

6. Tests and Content

Examiners may create tests manually or by using external AI tools and pasting generated HTML into the platform. You are responsible for the content you create and for ensuring that it is lawful and appropriate.

6.1 Public Tests and Irreversibility

Examiners have the option to make their tests publicly accessible. By choosing to publish a test, the examiner acknowledges and agrees that:

• The operation is irreversible — once a test is made public, it cannot be unpublished.
• The examiner assumes full responsibility for the content they publish.
• The platform owner is not responsible for any copying, redistribution, or unauthorized reuse of publicly available tests.
• Examiners must ensure that all published content respects copyright, intellectual property, and all applicable legal requirements.

6.2 Illegal or Unauthorized Content

Examiners are strictly forbidden from publishing or distributing:

• Copyrighted material without permission
• Illegal content of any kind
• Content that violates the laws of the European Union or the examiner’s own country
• Content that infringes on the rights of others

If an examiner publishes illegal or unauthorized content, their account may be immediately blocked, the content may be removed, and, where required, the applicable law will be enforced. The platform owner may cooperate with legal authorities when necessary.

7. Data Handling

The platform collects and processes only the data necessary for its operation (examiner accounts, test data, student identifiers, results, and technical logs). For full details, please refer to the ProXmTest Privacy Policy.

8. Account Deletion and Data Export

Examiners may request account deletion via the Google Form available on the website.

8.1 Cool‑off Period

After submitting a deletion request:

• A 48‑hour cool‑off period begins.
• During this time, the examiner may change their mind and cancel the request.
• After 48 hours, the account and all associated data are permanently deleted.

8.2 Data Export Before Deletion

Examiners who close their accounts may request a copy of their data before deletion. This may include:

• Created tests
• Student lists
• Test results

This data will be provided, where technically feasible, in MySQL or CSV format. Data export is only possible before the account and data are permanently deleted.

9. Availability of Service

ProXmTest is provided as a free service. While we aim to maintain stable and continuous operation, we do not guarantee uninterrupted availability.

Improper use by examiners — including excessive test generation, repeated requests, or actions that overload the server — may cause temporary service interruptions and may affect other users. Accounts that cause technical issues or degrade platform performance may be immediately suspended.

10. Disclaimer of Responsibility

ProXmTest is provided “as is”, without any warranties, express or implied, including but not limited to warranties of availability, fitness for a particular purpose, or non‑infringement.

As the platform owner, I am not responsible for:

• Errors or issues caused by incorrect or abusive use of the platform
• Consequences of examiners entering inaccurate, unlawful, or unauthorized data
• Misuse of the platform that leads to technical issues, data loss, or service interruption
• Actions performed by examiners or students under their accounts
• Damage resulting from credential sharing or improper account management
• Server overload or instability caused by excessive or unreasonable use
• Failures by examiners to comply with EU law or the laws of their own country
• Any indirect, incidental, or consequential damages arising from the use or inability to use the platform

Examiners are fully responsible for the content they create, the data they enter, and their compliance with all applicable laws and institutional rules.

11. Third‑Party Services

ProXmTest uses third‑party services such as hosting providers and Google Forms (for account deletion and contact). Each third‑party service is governed by its own terms and privacy policy. The platform owner is not responsible for the content, policies, or practices of third‑party services.

12. Changes to These Terms

These Terms & Conditions may be updated from time to time as the platform evolves. The latest version will always be available on this page. Continued use of the platform after changes are published constitutes acceptance of the updated Terms.
